General terms and conditions of sale

1. Purpose

These general terms and conditions of sale define the contractual relationship between the seller, Mrs. Valentine Verbeken (Atelier Gaby), and the buyer, as well as the conditions applicable to any purchase made via the website ateliergaby.be or through social media (Instagram, Facebook).

Purchasing a product implies full and unconditional acceptance of these general terms and conditions of sale, which the buyer acknowledges having read and accepted before placing an order.

The terms and conditions may be modified at any time in order to comply with new regulations or to improve the user experience. The applicable conditions are those in force at the date of the order.

2. Products

The products offered are those displayed on the website ateliergaby.be, within the limits of available stock. Each product is presented with a description of its main characteristics. The photographs are as faithful as possible but are not contractually binding.

⚠️ As the products are handcrafted and sometimes made from recycled materials, they may present slight variations or imperfections (size ± 1 cm, small pinholes, old threads or buttons, etc.), which do not constitute defects or non-conformity. Products with more significant imperfections are sold at a reduced price in the "Les imparfait(e)s" category, and their flaws are clearly presented there.

Products are intended for personal use. For professional use or resale, please contact us directly.

Custom / made-to-order products: Items made at the customer's request (custom, made-to-measure, or produced according to specific instructions) cannot be cancelled, exchanged, or refunded, in accordance with Article VI.53 of the Belgian Code of Economic Law.

3. Prices

Prices are indicated in euros (€), excluding taxes (VAT not applicable – small business exemption scheme, Article 56bis of the VAT Code).

Displayed prices do not include delivery fees, which are added during the checkout process.

The seller reserves the right to modify prices at any time. However, the price applied will be the one displayed at the time of the order.

4. Orders and Payment

Order validation implies acceptance of these terms and conditions.

Payment is made online using the following methods:

Wix Payments (credit card, debit card, Apple Pay)
PayPal
Online bank transfer

All transactions are secure. Payment data is processed directly by the payment providers (Wix Payments, PayPal, etc.) in accordance with current standards (SSL encryption, PCI DSS compliance). Atelier Gaby never has access to customers’ banking information.

If payment is refused (blocked transaction, insufficient funds, etc.), the order is automatically cancelled.

5. Delivery

Deliveries are handled by B-Post or Mondial Relay, to home addresses or pickup points.

Delivery available in Belgium, France, Luxembourg, Portugal, the Netherlands, Italy, Switzerland.
Delivery time: 3 to 7 working days (indicative, may vary depending on the carrier).
Free delivery for purchases over €50.
Free pickup, by appointment, in Woluwe-Saint-Lambert.

6. Right of Withdrawal and Returns

In accordance with Articles VI.47 to VI.53 of the Belgian Code of Economic Law, the customer has 14 working days from delivery to exercise their right of withdrawal, without needing to provide justification.

To exercise this right, the customer must notify their decision in writing (email: ateliergaby.be@gmail.com).

Products must be returned in perfect condition, unused, and in their original packaging.
Return shipping costs are borne by the customer.
Refunds include the price of the products and initial delivery costs.
Refunds will be processed within 14 days after receiving the returned items, using the same payment method as the original order.

⚠️ Exceptions: Custom-made, personalised, or used products cannot be returned or refunded.

7. Warranty

All products benefit from a 2-year legal warranty (European Directive 1999/44/EC). The warranty does not cover:

normal wear and tear,
defects known and accepted at the time of purchase,
inappropriate use of the product.

In case of defect, the customer must inform the seller within a reasonable timeframe.

8. Liability

The seller cannot be held responsible for delivery delays attributable to the carrier, nor for indirect damages related to the use of the products.

9. Intellectual Property

All elements of the website ateliergaby.be (texts, photos, design, logo) are the exclusive intellectual property of Mrs. Valentine Verbeken. Any reproduction, even partial, is prohibited without prior authorization.

10. Data Protection

Atelier Gaby is committed to respecting the confidentiality of personal data collected (see the site's Privacy Policy). Customers have the right to access, correct, or delete their personal data at any time (email: ateliergaby.be@gmail.com).

11. Applicable Law and Disputes

These general terms and conditions are governed by Belgian law. Any dispute falls under the exclusive jurisdiction of the courts of Brussels (Belgium).
